1. About These Terms

These Terms of Service apply when you visit www.genkibody.co or purchase products from Genki Body.

In these Terms, “we”, “us” and “our” mean:

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products to you. Shopify is not the seller of the products purchased from Genki Body.

By using our website or placing an order, you agree to these Terms, together with our Refund Policy, Shipping Policy and Privacy Policy.

Nothing in these Terms limits or excludes your statutory rights under UK consumer law.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to place an order.

You are responsible for ensuring that the information supplied during checkout is complete and accurate.

3. Product Information

We take reasonable care to ensure that product descriptions, specifications, photographs and prices are accurate.

Product colours and appearance may vary slightly depending on lighting, production batches and the screen used to view the website. Minor differences that do not materially affect the product’s function are not necessarily faults.

Product packaging, accessories and specifications may only be changed where the change does not materially reduce the product’s quality or functionality and remains legally compliant.

4. Health and Product Use

Our products are intended for personal cosmetic and wellness use unless expressly stated otherwise. They are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Information provided on our website is general product information and is not medical advice. Results can vary between individuals and no particular result is guaranteed.

You must read and follow all instructions, safety warnings, contraindications and usage guidance supplied with the product.

Do not use a product where a warning or contraindication applies to you. If you are pregnant, receiving medical treatment, taking photosensitising medication, have a light-sensitive condition, have concerns about your eyes or skin, or are uncertain whether a product is suitable for you, seek advice from an appropriately qualified healthcare professional before use.

This section does not exclude our responsibility to supply products that are safe, of satisfactory quality, fit for purpose and as described.

5. Prices

Prices are displayed in pounds sterling (GBP) and include applicable taxes where required.

Any delivery charges will be shown before you complete checkout. Where free delivery applies, no separate standard delivery charge will be added.

We may change prices at any time, but a price change will not affect an order we have already accepted.

If a product is listed at an obviously incorrect price because of a genuine error, we may contact you before accepting the order and offer you the choice of purchasing at the correct price or cancelling for a full refund.

6. Placing and Accepting Orders

After placing an order, you will receive an order acknowledgement. This acknowledges receipt of your order but does not necessarily mean that it has been accepted.

A binding contract is formed when we send confirmation that the order has been dispatched, unless we expressly confirm acceptance at an earlier stage.

We may decline or cancel an order before dispatch where:

  • the product is unavailable;

  • payment cannot be authorised;

  • the delivery information is incomplete or invalid;

  • we reasonably suspect fraud or misuse;

  • an obvious pricing or product information error has occurred; or

  • fulfilling the order would breach a legal or regulatory requirement.

If payment has already been taken for an order we cannot fulfil, we will issue a full refund.

7. Payment

Payment must be made using one of the payment methods available at checkout.

You confirm that you are authorised to use the selected payment method. Payment processing may be carried out by Shopify Payments or another payment provider, subject to that provider’s terms and security checks.

We do not store complete payment-card details on our own systems.

8. Delivery

We currently deliver only to eligible United Kingdom addresses shown as available during checkout.

Estimated delivery times are provided in good faith but are not guaranteed unless expressly agreed. We will deliver within the period stated at checkout or, where no different period has been agreed, within the period required by applicable law.

You are responsible for supplying a complete and accurate delivery address. Please contact us immediately if you notice an error. We cannot guarantee that an address can be changed after dispatch.

Risk of loss or damage passes to you when the goods are delivered to you or to a person identified by you to receive them.

9. Cancellations, Returns and Refunds

Your cancellation, return and refund rights are explained in our Refund Policy, which forms part of these Terms.

UK consumers generally have the right to cancel an online order within 14 days after receiving the goods, subject to applicable legal exceptions. After notifying us of cancellation, the customer generally has a further 14 days to return the goods.

Products that are faulty, unsafe, not as described or not fit for purpose are covered by applicable UK consumer law.

Please contact us before returning a product so that we can provide the correct UK return address and instructions. This request does not restrict your statutory cancellation or return rights.

10. Product Availability

All products are subject to availability. Adding a product to your basket does not reserve it.

If an item becomes unavailable after an order is placed, we will contact you and provide an appropriate replacement option, revised delivery estimate or full refund.

11. Warranty and Statutory Rights

Any commercial warranty offered with a product is additional to your statutory rights and does not replace or restrict them.

Details of any applicable commercial warranty will be stated on the product page or in the documentation supplied with the product.

12. Acceptable Use of the Website

You must not:

  • use the website for unlawful or fraudulent purposes;

  • attempt to gain unauthorised access to the website or related systems;

  • introduce viruses, malicious code or other harmful material;

  • interfere with the website’s security or operation;

  • copy or commercially exploit website content without permission; or

  • place false, speculative or fraudulent orders.

We may suspend access or cancel affected orders where we reasonably believe the website or ordering process is being misused.

13. Intellectual Property

The content of this website, including the Genki Body name, text, graphics, photographs, videos, page design and branding, is owned by or licensed to us unless otherwise stated.

You may view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, modify or commercially exploit our content without prior written permission.

14. Reviews and User Content

If you submit a review, photograph or other content, you confirm that it is truthful, relates to your genuine experience, does not infringe another person’s rights and is not unlawful, abusive or misleading.

You retain ownership of your content but grant us a non-exclusive, royalty-free permission to display and use it in connection with our website and business. We will not materially alter the meaning of a customer review.

We may remove content that breaches these Terms or applicable law.

15. Third-Party Services and Links

Our website may contain links to third-party websites or use services supplied by third parties, including payment and delivery providers.

We are not responsible for the content or independent practices of third-party websites. Your use of those services may be subject to separate terms.

This does not exclude our responsibility for subcontractors or service providers where the law makes us responsible for their acts or omissions.

16. Our Responsibility to You

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We do not exclude or limit liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • defective products where liability cannot legally be excluded; or

  • breach of your statutory consumer rights.

We are not responsible for losses that were not foreseeable, losses caused by information or instructions supplied incorrectly by you, or business losses arising from a consumer purchase.

17. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control. We will take reasonable steps to minimise the effect and will contact you where your order is materially affected.

Your legal rights concerning delayed or undelivered goods remain unaffected.

We process personal information in accordance with our Privacy Policy. Please review that policy to understand how we collect, use and protect your information.

19. Changes to These Terms

We may update these Terms to reflect changes to our business, website or applicable law.

The Terms applying to your order will normally be those published when the order was placed. Changes will not retrospectively reduce your contractual or statutory rights.

20. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

21. Governing Law and Disputes

These Terms are governed by the applicable laws of the United Kingdom.

If you live in England or Wales, the courts of England and Wales will generally have jurisdiction. If you live in Scotland or Northern Ireland, you may bring proceedings in the courts applicable where you live.

We encourage you to contact us first so that we can try to resolve any concern fairly and promptly.
